The Ohio House is debating a bill that would require scrap metal yards to copy ID’s and require proof that you own something before you scrap it with them. I’m a tad cynical but god knows metal theft has been affecting my clients and the sale of their homes for a few years. It’s definitely a problem that has gotten worse not better. Scrap metal yard owners say there are already laws on the books - then why is this such an on-going problem? Should the laws be Statewide? Local communities (some) are saying that they have more stringent local laws that apply. My real concern is how does all this get enforced? You can pass a million laws but without enforcement ……..

Here is a story from The Enquirer in Kentucky where they are considering similar laws. One idea I liked (I think) was that any metals brought in that garnered $10 or less in cash to the person bringing in the metal would be paid electronically or by check. (Unless of course this means the ‘pros’ would just make sure they strip a house completely so they can get more money for each ‘job’) Quote from article:
“This is a really good, strong first step to identify those people who are illegally dealing in these metals,” said Denham, D-Maysville.
Some Kentucky cities already have similar requirements in place. But a statewide law is needed, Denham said.
Similar or related proposals are under consideration in other states, including Maine, Maryland, Nebraska, South Dakota and Tennessee. In Nebraska and Tennessee, lawmakers are considering proposals that would also require scrap metal sellers to give a fingerprint.”
We (my clients and I) had an appraiser come to the house on Monday. My clients already live out of town, the house has been vacant for a few months and unfortunately the copper pipes in the basement were cleanly cut (no amateur job) and discovered by the appraiser. I was at the home on Friday and the theft had not ocurred yet. Sigh. Way too common, it can completely kill a sales offer, it lowers the selling price of a home, not to mention the fact it’s a violation of personal property of the most basic kind.

This is such a sad situation. Theft only compounds the problems we are having in the real estate industry. I have to agree with you, who’s going to enforce it?
Maybe we need to invent some kind of invisible paint that only shows up when someone steals scrape metal. It should permanently dye their hands with a Scarlet Letter.

Should be make it in plaid? That would particularly noticeable and nauseating.
